Welcome to Postia. These Terms of Service ("Terms") govern your access to and use of the Postia website, software and related services ("Service"). By creating an account or using Postia, you agree to these Terms.

If you do not agree with these Terms, you must not use the Service.

1. About Us

Postia is operated by My Viral Vault Ltd ("Postia", "we", "our", "us").

The Service helps users create, schedule and manage Pinterest marketing content.

2. Eligibility

You must:

• Be at least 18 years old.
• Have authority to enter into these Terms.
• Provide accurate account information.
• Keep your login details secure.

You are responsible for all activity that occurs under your account.

3. Your Account

You agree to:

• Keep your email address up to date.
• Keep your password secure.
• Notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts where we reasonably believe unauthorised access has occurred.

4. Subscription Plans

Postia offers free trials and paid subscription plans.

Plan limits may include:

• Daily pin generation
• Scheduled pin queue size
• AI image generation credits
• Traffic Engine credits
• Other feature limits

Current pricing is displayed on our website.

We may update pricing for future billing periods. Existing subscribers will receive reasonable notice before any pricing changes take effect.

5. Billing

Subscriptions renew automatically until cancelled.

Payments are processed securely through Stripe.

By subscribing you authorise recurring payments using your chosen payment method.

If payment fails, we may suspend your subscription until payment is successfully collected.

6. Cancellation

You may cancel your subscription at any time through your account dashboard.

Your subscription will remain active until the end of your current billing period.

No partial refunds are provided for unused subscription time unless required by law.

7. Refund Policy

Due to the digital nature of the Service, subscription fees are generally non-refundable.

If you believe you have been charged in error, please contact support within 14 days.

Nothing in these Terms affects your statutory rights under UK consumer law.

8. Pinterest Account Connection

Certain features require you to connect your Pinterest account.

You authorise Postia to interact with Pinterest solely to provide the Service you request.

You remain responsible for:

• Your Pinterest account
• Your Pinterest boards
• Your published content
• Compliance with Pinterest's Terms

Postia is not affiliated with or endorsed by Pinterest.

9. User Content

You retain ownership of all content you upload.

By using the Service you grant Postia a limited licence to process, analyse, store and publish your content where necessary to provide the Service.

We do not claim ownership of your intellectual property.

10. Acceptable Use

You agree not to use Postia to:

• Publish spam
• Send misleading or deceptive content
• Infringe copyright or trademarks
• Promote illegal products or services
• Promote hate speech or violence
• Publish adult content where prohibited
• Manipulate Pinterest engagement
• Attempt to bypass platform restrictions
• Interfere with our systems
• Reverse engineer the software
• Use automated tools to abuse the Service

We may immediately suspend or terminate accounts that violate this policy. See our full Acceptable Use Policy for details.

11. Anti-Spam Policy

Postia is designed to encourage sustainable Pinterest marketing.

Pins identified by our safety systems as high-risk, repetitive or spam-like may:

• Be blocked
• Require editing
• Be prevented from scheduling

Repeated attempts to publish prohibited content may result in account suspension.

Our decision on safety enforcement is final.

12. AI Features

Some features generate text or images using artificial intelligence.

AI-generated content may:

• Contain inaccuracies
• Require editing
• Produce similar outputs for different users

You remain solely responsible for reviewing content before publishing.

13. Availability

We aim to provide reliable service but cannot guarantee uninterrupted availability.

Scheduled maintenance, software updates or third-party outages may temporarily affect the Service.

14. Third-Party Services

Postia integrates with third-party services including:

• Pinterest
• Etsy (via the Etsy API)
• Stripe
• OpenAI
• Other providers

We are not responsible for outages, API changes or decisions made by those providers.

14a. Etsy API — Data Access and Use

Where Postia accesses data via the Etsy API, the following terms apply in addition to the rest of this agreement:

• Your data only. Postia uses the Etsy API solely to import your own listing data — titles, descriptions, images, tags and price — into your own Postia account. No buyer data, financial data, shop-management data or data belonging to third parties is accessed.
• Read-only. Postia never writes to, modifies, or deletes any data on Etsy. Your listings remain entirely unchanged.
• No automated posting to Etsy. Postia does not push content, create listings, or take any action on your Etsy account.
• User approval required. All Pinterest pin content generated from your Etsy data is reviewed and approved by you before it is scheduled or published. Nothing is posted automatically.
• Data freshness. Imported listing data reflects the state of your listings at the time of import. If your Etsy listings change, re-import your data in Postia to keep it current.
• Storage and security. Etsy listing data you import is stored securely on Postia's infrastructure and used only to provide the Service to you. It is deleted within a reasonable period after account closure. See our Privacy Policy for full details.
• Not endorsed by Etsy. The term "Etsy" is a trademark of Etsy, Inc. Postia uses the Etsy API but is not endorsed or certified by Etsy.

By connecting your Etsy account or importing Etsy listing data, you confirm that you are the owner of that Etsy shop and that you have the right to import and use that data in connection with the Service.

15. Intellectual Property

The Postia software, branding, website and underlying technology remain the exclusive property of My Viral Vault Ltd.

You may not:

• Copy
• Sell
• Licence
• Modify
• Reverse engineer
• Redistribute

any part of the Service without written permission.

16. Limitation of Liability

To the fullest extent permitted by law:

Postia is provided "as is" without warranties of uninterrupted operation or specific business results.

We are not liable for:

• Lost profits
• Lost sales
• Loss of Pinterest traffic
• Loss of followers
• Account suspensions by Pinterest
• Indirect or consequential losses

Our total liability shall not exceed the amount you paid to Postia during the previous 12 months.

Nothing excludes liability that cannot legally be excluded under UK law.

17. Indemnity

You agree to indemnify and hold harmless My Viral Vault Ltd against claims arising from:

• Your misuse of the Service
• Content you publish
• Breach of these Terms
• Violation of applicable law

18. Suspension and Termination

We may suspend or terminate accounts immediately where we reasonably believe there has been:

• Fraud
• Payment abuse
• API abuse
• Spam activity
• Security threats
• Breach of these Terms

Termination does not remove your obligation to pay outstanding fees.

19. Changes to the Service

We may modify, improve or discontinue features at any time.

We will provide reasonable notice where changes materially affect paying subscribers.

20. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after updates constitutes acceptance of the revised Terms.

21. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
